POST-ARREST BAIL PETITION UNDER SECTION 497 Cr.P.C IN CASE FIR NO. 479/2025, U/S 13/20/65 DATED 28/05/2025, REGISTERED AT P.S SHALIMAR, ISLAMABAD

Respectfully Sheweth:

  1. That the petitioner/accused has been falsely implicated in case FIR No. 479/2025 dated 28.05.2025, registered at Police Station Shalimar, Islamabad, under Section 13 of the Arms Ordinance, 1965.
  2. That the petitioner is a law-abiding citizen and is employed as a Security Guard with Leon Security Services (Pvt.) Ltd., a duly registered and licensed private security company.
  3. That the rifle alleged to have been recovered from the petitioner, i.e., .223 bore rifle, was handed over to him by his employer along with a copy of the valid license, for the purposes of duty at his assigned post.
  4. That at the relevant time, the petitioner was on official duty and upon inquiry by the police, he immediately presented the copy of the valid license issued in the name of his employer. However, the police, with mala fide intentions and ulterior motives, disregarded the same and proceeded to falsely register the FIR against the petitioner.
  5. That the entire prosecution case is based on misrepresentation of facts and the petitioner is being used as a scapegoat, despite having lawful authority to possess the subject weapon for security purposes under the supervision of a licensed company.
  6. That the petitioner has been behind bars since his arrest and no fruitful purpose would be served by keeping him incarcerated, as the investigation does not require further custodial interrogation.
  7. That the offence alleged does not fall within the prohibitory clause of Section 497 Cr.P.C, and the petitioner is entitled to the concession of bail as a matter of right in such circumstances.
  8. That the petitioner has no previous criminal record, and is ready to furnish surety to the satisfaction of this Hon’ble Court. He undertakes to fully cooperate with the investigation and will appear before the trial court as and when required.
  9. That the petitioner seeks indulgence of this Hon’ble Court for grant of post-arrest bail, as his continuous detention amounts to misuse of process of law and is a sheer violation of his fundamental rights.

PRAYER

In view of the foregoing, it is most respectfully prayed that this Hon’ble Court may graciously be pleased to:

Grant post-arrest bail to the petitioner/accused Arooj Mushtaq in FIR No. 479/2025, dated 28.05.2025, registered at Police Station Shalimar, under Section 13 Arms Ordinance, 1965, till the conclusion of the trial, in the interest of justice.

Any other relief deemed just and proper may also be granted.
